Court documents state, “On November 12, 2018 at 0309 Officer Nathan Lane was dispatched to the Emergency Room in reference to a male subject entering the ER with a gunshot wound to the head. Upon arrival Officer Lane was advised by medical staff of a black male subject who was in the Radiology wing of the hospital. Officer Lane met with him and observed his face to be covered in dried up blood and fresh bright red blood flowing from the right side of his face above his right eye.

“He stated the following: His cousin, John Harper, was wanting to meet him at a house on the corner of Agee Street and Austin Street. When he got there Harper was showing him a vehicle he had purchased. Harper along with a black male subject he knows as ‘Zay’, the home owners were all gambling at the residence. ‘Zay’ was described as being a black male shorter than five foot eleven inches, light skin and having dread locks. ‘Zay’ and Harper are regularly seen together. The victim stated at around 0300 hours he was going to leave. When he was walking in-between his car and the house ‘Zay’ ran up behind him and pointed a black semi-automatic handgun at his face. Harper who was standing next to ‘Zay’, told him to give it up and give ‘Zay’ all he has. The man grabbed the handgun and ‘Zay’ shot him in the face. After he fell to the ground, someone grabbed his wallet out of his back pocket and loose money in his front pockets totaling approximately $200.00 in cash. He was able stand and get to his vehicle and drive to the hospital.”

Court documents state, “On November 30, 2018, I (Capt. Voss) was at 774 Lucas Lane trying to make contact with Xavier Davis. Davis had active warrants for robbery and a parole violation. I made contact with Monika Goyson and I advised her why I was there. She told me Davis was not there and to wait a minute and I could come inside and look. She came back to the door and she asked me to wait another minute. I told Goyson if Davis was inside the house to please let me take him into custody, She told me he was not there and left the door again.

“I heard Goyson taking to a male subject inside the house and then she came back to the front door and advised me Davis was not there. It was at this time Davis fled from the house and was later arrested.Goyson showed me the room Davis was in and it was the same room I had heard the male voice. Goyson gave me permission to look for a gun inside the room and I noted a black backpack, and inside the back pack were several baggies with marijuana residue inside them. There was also a plastic container with marijuana residue inside.

“I told Goyson I was contacting the parole office concerning the drug use. While waiting outside Goyson cleaned the room and destroyed the baggie and containers before parole arrived.”
